Article 1
These Regulations are determined pursuant to Article 34-1, Paragraph 2 of the Air Pollution Control Act.
Article 2
"Motorized vehicles" as referred to in this Act means vehicles that travel on roadways under their own power and do not operate on rails or other electric power systems.
However, it does not include electric vehicles.
Article 3
The engine of motor vehicle parked or idling in the following places shall be turned off:
I.
Public or private parking lots.
II.
Roads (not including freeways, highways and expressways)
III.
Other parking, pick up, or transfer areas for motor vehicles.
Article 4
The foregoing article shall not apply in the following circumstances when parking and idling is necessary.
IV.
Special vehicle that comply with road and transportation safety regulations engaged in work.
V.
Refrigeration or cold storage vehicle carrying or transporting goods, cargo container truck with harbor container, and broadcasting vehicle in operation.
VI.
Based on passenger’s health and safety considerations, vehicle for transportation of children, tour bus and public bus may start the engine 15 minutes prior to passengers
boarding, after all passengers have get off, the engine must be turn off for the parked vehicle.
VII.
Taxi with driver in the driver's seat lines up to wait for customers.
VIII.
Motor vehicle that have to park or be idle because of traffic control, traffic jam or road accident.
IX.
When the Central Weather Bureau has forecasted on the date of parking or after 5 pm the previous day to indicate that the maximum temperature of the special municipality,
county, or city (within which the vehicle is parking) is over 30 degree Centigrade.
X.
When the time of vehicle parking is raining no matter it is heavy rain or light rain.
XI.
While passengers (exclude the driver) are getting on or getting off the vehicle.
XII.
Idling is necessary to execute road rescue; engine power is required for loading and unloading goods; idling is required to manual operating the regeneration function
of Diesel Particulate Filter, or due to mechanical failure over which the operator has no control.
XIII.
Vehicle is being performed the regulatory required idle emissions test.
XIV.
Other special circumstances or vehicles as officially announced by the competent authority.
Article 5
These Regulations shall take effect on March 1, 2012.
The revisions of these Regulations shall take effect on the date of promulgation.
